Please read this Informed Consent carefully before your first visit. It explains how telehealth works, its benefits and risks, and your rights and responsibilities. By checking the consent box (or signing below), you agree to it. This Informed Consent works alongside our Terms of Service [Terms of Service URL] and the Medical Practice's Notice of Privacy Practices [Notice of Privacy Practices URL].

1. Who Provides Your Care

DrsOnCalls LLC ("DrsOnCalls," "we," "us") operates the DrsOnCalls website and mobile applications (the "Platform"). DrsOnCalls is a technology and administrative services company. DrsOnCalls is not a medical provider, does not practice medicine, and does not control or interfere with the clinical judgment of any provider.

All medical care is provided by [Insert MD's Florida Professional Entity Name] (the "Medical Practice") and its licensed healthcare professionals ("Providers"). Your treatment relationship is with the Medical Practice and your Provider, who are solely responsible for the medical care you receive.

2. What Telehealth Is

Telehealth is the delivery of healthcare services using electronic communications and information technology. Through the Platform, care may be delivered by:

  • Live (synchronous) video or audio visits in real time with a Provider;
  • Secure messaging with your Provider before or after a visit; and
  • Review of information you upload, such as photos, documents, medication lists, and test results.
  • During a visit, your medical history and health information may be discussed with you and, when needed for your care, with other healthcare professionals. Telehealth does not include a hands-on physical examination.

    3. Your Providers

  • Providers are licensed in the State of Florida and may include physicians (MD/DO), physician assistants (PA-C), and advanced practice registered nurses (APRN). PAs and APRNs practice under physician supervision or protocol as required by Florida law.
  • Your Provider's name, credentials, and license type will be shown to you before or at the start of your visit. You may ask about a Provider's qualifications at any time.
  • Nurses and other clinical staff may assist with your care under the supervision of a licensed Provider.
  • 4. Consent to Care

    You consent to and authorize the Providers you engage through the Platform to provide routine medical care that is appropriate for telehealth, which may include evaluation, diagnosis, treatment of illnesses and injuries, prescriptions when clinically appropriate, orders for laboratory or imaging tests, patient education, follow-up, and referrals to other providers. You will have the opportunity to ask questions about any proposed treatment, including its benefits, risks, and alternatives, before you agree to it.

    5. Eligibility, Location, and Identity

  • Location. You must be physically located in the State of Florida at the time of every live visit and every clinical message exchange. You agree to truthfully state your location and to tell your Provider if it changes. Providing false location information may violate state medical licensing laws, and your Provider may end the visit.
  • Identity. You must show a valid government-issued photo ID to your Provider at the start of your first live visit, and at later visits if requested.
  • Accurate Information. You must completely and accurately fill out all intake questionnaires, including current medications, allergies, pre-existing conditions, and recent test results, before your live visit, and keep this information up to date.
  • Age and Account. You must be 18 or older to create an account and consent for yourself. Your account is for your personal use only and may not be shared or transferred. Family plan members must each complete their own intake.
  • 6. Care for Minors

    If the patient is under 18, you represent that you are the patient's parent or legal guardian and are authorized under Florida law to consent to care for the minor. A parent or legal guardian must be present for the entire visit unless Florida law allows the minor to consent to that care on their own. References to "you" in this Informed Consent include the minor patient where they concern the person receiving care.

    7. Benefits of Telehealth

  • Convenient access to care without travel, from home or work.
  • Shorter wait times for evaluation and more efficient follow-up.
  • Access to Providers and specialists who may be located at a distance from you.
  • While these benefits are expected, no specific results can be guaranteed.

    8. Risks and Limitations

    As with any medical service, there are risks. These include, but are not limited to:

  • The lack of a hands-on physical exam means your Provider relies heavily on what you report and what can be seen on video or in photos. Some conditions cannot be properly diagnosed or treated by telehealth.
  • Information sent may be insufficient (for example, poor image or video quality) for the Provider to make an appropriate medical decision.
  • Technical problems such as dropped calls, poor connections, or equipment failure may delay or interrupt care. If a visit is disconnected, your Provider may try to reach you by phone or message.
  • If your Provider does not have access to your complete medical records, errors in judgment, adverse drug interactions, or allergic reactions could occur.
  • Although the Platform uses security safeguards, in rare cases these safeguards could fail and result in a breach of the privacy of your health information.
  • 9. Provider Discretion and Referrals

    Your Provider has full clinical discretion to decide whether your condition is appropriate for telehealth. Your Provider may decline to treat you, end a visit, decline to prescribe a medication you request, or refer you to in-person care, urgent care, a specialist, or an emergency department. A referral or decision not to treat is a clinical decision made for your safety.

    10. Prescriptions

  • Prescriptions are issued only when your Provider determines they are medically appropriate. A visit does not guarantee a prescription.
  • Under Florida and federal law, certain controlled substances cannot be prescribed through telehealth. Providers will not prescribe controlled substances except as specifically permitted by law.
  • Prescriptions are sent electronically to the pharmacy you choose. Medication costs are paid directly to the pharmacy and are not included in your visit fee or membership.
  • 11. Emergencies

    TELEHEALTH IS NOT AN EMERGENCY SERVICE. If you have a medical emergency, including chest pain, trouble breathing, signs of stroke, severe bleeding, a severe allergic reaction, or any life-threatening condition, before, during, or after a visit, disconnect immediately and call 911 or go to the nearest emergency room.

    If you are having thoughts of harming yourself or others, or are in a mental health crisis, call or text 988 (Suicide & Crisis Lifeline) or call 911. Secure messages are not monitored 24 hours a day and must never be used for urgent or emergency needs.

    12. Messaging and Follow-Up

    Each consultation includes a follow-up messaging period as described on the Platform. Providers aim to respond to messages within [insert response time, e.g., 24 hours during business hours], but response times are not guaranteed. Additional messaging beyond the included period may carry a fee, as shown on the Platform before you purchase. If your symptoms get worse, do not wait for a message reply; seek in-person or emergency care.

    13. Electronic Communications

    You consent to receive appointment reminders, visit summaries, and other communications, which may contain protected health information, by email, SMS text message, push notification, and secure in-app messaging. Standard email and text messages are not fully secure and could be read by others. You may opt out of email or text communications at any time by contacting support@drsoncalls.com; secure in-app messaging will remain available. Message and data rates may apply.

    14. Privacy, Security, and Medical Records

  • The laws that protect the privacy and security of health information, including HIPAA and Florida law, apply to telehealth. The Platform uses encryption and other network and software security protections to safeguard your information.
  • Your health information will not be sold and will not be disclosed to researchers or other third parties without your written authorization, except as permitted or required by law (as described in the Notice of Privacy Practices).
  • Your medical records are maintained by the Medical Practice for the period required by Florida law. You have the right to access and receive copies of your records, for a reasonable fee as permitted by law.
  • Your information may be shared with other healthcare professionals involved in your care, who may be located in other areas, including out of state.
  • With your permission, the Medical Practice can send a summary of your visit to your primary care provider.
  • 15. Recording

    Telehealth visits are not recorded by the Medical Practice or DrsOnCalls without your prior consent. Photos, images, or documents you upload become part of your medical record. You agree not to record any visit, in audio or video, without the Provider's express consent. Florida law requires the consent of all parties to record a conversation.

    16. Your Visit Setting

    You agree to join visits from a private location where you are comfortable discussing your health, using a reliable internet or phone connection. Tell your Provider if anyone else is present in the room or on the call. You may ask for others to leave at any time, and your Provider may ask to speak with you privately.

    17. Coordination with Your Other Providers

    Telehealth through the Platform is not intended to replace your primary care provider. You are responsible for telling your Provider about other care you are receiving, including other telehealth services, and for following up with your primary care provider or specialists as recommended. Laboratory tests, imaging, and in-person services ordered or referred by your Provider are performed by outside facilities, which bill you separately.

    18. Mental and Behavioral Health Services

    If you receive mental or behavioral health care, your Provider will explain your proposed treatment, its expected duration (when known), and its cost. You may ask about other treatment options, seek a second opinion from another professional, or end treatment at any time. Some mental health conditions are better treated in person, and your Provider may refer you accordingly.

    19. Financial Responsibility

  • Not Insurance. A DrsOnCalls membership is not health insurance and does not meet the requirements of health insurance coverage. It does not replace health insurance. We encourage you to maintain health insurance for hospital, emergency, specialist, and other care not provided through the Platform.
  • Fees. Visit fees, membership fees, and messaging fees are shown on the Platform before you purchase and may change from time to time. DrsOnCalls collects payment on behalf of the Medical Practice, and a portion of each payment is retained by DrsOnCalls for administrative and technology services. Payments are processed by a third-party payment processor.
  • No Insurance Billing. Neither DrsOnCalls nor the Medical Practice submits claims to health insurance. You are responsible for the full fee at the time of service. You may ask for a receipt to submit to your health plan, HSA, or FSA, but reimbursement is not guaranteed.
  • Medicare and Medicaid. Providers on the Platform do not bill Medicare or Medicaid. If you are enrolled in Medicare or Medicaid, you must tell us before your visit. [Attorney to confirm Medicare private-contract / opt-out requirements before accepting Medicare beneficiaries.]
  • Renewals and Refunds. Memberships renew automatically unless canceled. Cancellation, refund, and renewal terms are described in the Terms of Service.
  • 20. Your Rights

  • You may refuse telehealth, or withdraw your consent to telehealth, at any time without affecting your right to future care. Withdrawing consent does not cancel payments already owed for care received.
  • You may choose other forms of care, including in-person visits with another provider, at any time.
  • You may ask questions and receive answers about your diagnosis, treatment, and costs.
  • You may request an interpreter or reasonable accommodation for a disability, free of charge, by contacting support@drsoncalls.com.
  • You may file a complaint with the Medical Practice or DrsOnCalls at support@drsoncalls.com, or with the Florida Department of Health.
